Rental Rules & Agreement


Nitta Condo #110

Most renters, tenants and vacationers are great & responsible people who arrive at our residence ready to relax and enjoy a wonderful time in paradise. And we have put together a set of guidelines (rules & regulations) to insure that you can do just that.

Air Conditioning

The cost of electricity is very, very expensive in Mexico. Much of the time, the ceiling fans provide most of the cooling needed. The more electricity you use, the higher the per kilowatt unit rate is. When one uses more than the basic allowance, the rate per kilowatt can double or triple….causing an electric bill that is more than you paid to rent the condo. Please help us by keeping the air condition down or completely off when leaving the condo to go outside. Tenant agrees that Air conditioning shall not be set below 75 degrees and that the doors and windows shall be closed when either heat or air conditioning is in operation.

Beach towels & other Accessories

Bring your own beach towels and play equipment. Nearby there are many stores that sell low cost beach equipment, towels and accessories. Towels, dishes, and all other furnishings in the condo are not allowed to leave the inside of the condo.

Satellite TV

Satellite TV is provided and service level has been chosen by the Landlord. No refund of rents shall be given for outages, content provided, lack of content, or personal preferences with regard to satellite TV service.

Cancellation policy

No shows, late arrivals, change in number of persons, and early departures after arrival are non-refundable. Notice of cancellation MUST be submitted in writing. Notice given over the telephone will not be considered valid and will NOT be accepted. Because airline schedules must be booked months in advance, our clients often make their reservations 1 year in advance. When you make your reservation, you have reserved your time slot, rendering it not available for others who inquire about the same time. If you have a change of plans, people who wanted your time slot have already been turned away, forcing them to reserve elsewhere.

  • 8-24 month advance notice cancellation = 100% refund
  • 6-8 month advance notice cancellation = 50% refund
  • 4-6 month advance notice cancellation = 25% refund
  • 3 month to last minute cancellation = 0% refund

Check in time

Check in time is at 3:00 PM.

Check out time

Check out time is 10:00 am sharp. A $50.00 fee will be charged on all late checkouts, as our cleaning people arrive at 10:30 am. We have to pay them while they wait.

Check Out / Cleaning Policy:
  • Clean refrigerator. Do not leave any food or drink in the refrigerator or cupboards.
  • Dispose of all garbage into the garage area where the trash bins are located.
  • Clean stove, range & grill, counter tops, sinks and appliances. Wipe all surfaces so that they are free of grease and food.
  • Clean bathrooms (including toilets, sink, shower)
  • Sweep the floors.
  • If you used the outdoor gas grill, be sure that it has been cleaned (clean only with a "soft" bush) and the actual propane tank valve has been turned off.
  • Remove all sheets off the beds and place on the floor near the washer/dryer so the deep cleaning person can easily find them.
  • Remove all towels and wash cloths and place on the floor near the washer/dryer.
  • Unplug the water cooler and drain all water. Turn off the switch located on the back of the cooler.

Children

Please don’t leave your children unattended! The facilities are very big and so we want to ask you to supervise your children closely. We are sure, you can take proper care of your children but this is just a reminder.

Cleaning/maid service

There is no cleaning or maid service provided on condo rentals. If you would like to pay for a person to come in to do that, it can be arranged.

Cleaning responsibilities

The Tenants shall maintain the premises in a good, clean, and ready to rent condition, and use the premises only in a careful and lawful manner. The tenants shall leave the premises in a ready to rent condition at the expiration of the rental agreement, defined by the Landlord as being immediately habitable by the next tenants. Tenants shall pay for maintenance and repairs should the premises be left in a lesser condition. The tenants agree that the Landlord shall deduct costs of said services from the security deposit prior to refund if tenants cause damage to the premises or its furnishings.

Condo association liability

The Tenants and Tenants' Guests shall hereby indemnify and hold harmless the Nitta Condo Association against any and all claims of personal injury or property damage or loss arising from use of the premises regardless of the nature of the accident, injury or loss. Tenants expressly recognize that any insurance for property damage or loss which the Landlord may maintain on the property does not cover the personal property of Tenants, does not cover any accident, injury or medical insurance and that Tenants should purchase their own medical, loss or any other insurance for Tenants and Guests if such coverage is desired.

Condo furnishings

Missing items, damage to furnishings, furniture, appliances and premises and will be charged to you. Guest agrees to pay for any damage made.

Damage

The Tenants shall pay for any damage done to the premises over and above normal wear and tear. Any and all damage determined to have been caused by a Guest's occupancy will result in the cost of repairs and/or replacements to be deducted from the security deposit. To avoid any claims against the deposit, we ask that you treat the rental property as you would your own home.

Departure cleaning fee

Any furniture or carpet cleaning due to guest carelessness will incur an additional cleaning fee of $100 which will be deducted from the security deposit.

Deposit for reservation

50% minimum deposit is required for confirmed reservations

DVDs

The owners, as a personal service, provide hundreds of DVDs for use by our guests. We want them to enjoy their visit. However, DVDs are inventoried before and after each arrival. Missing DVDs will be charged $20 each.

Early departures

There will be no refunds on any Early Departures. No exceptions!

Electric stove & gas grill

Tenant is advised that the property contains a electric stove and cook top, gas grill, and other energy powered items and will seek help from management if the proper operation of such items is not fully understood.

Enforcement

Tenants agree to pay all reasonable costs, attorney's fees and expenses that shall be made or incurred by Landlord enforcing this agreement.

Firearms & hazardous materials

Tenant agrees that Fireworks and other hazardous materials shall not be used in or around the property.

Furniture

Our floors are highly polished marble which can be easily scratched and damaged. We have the best floors in the Nitta complex. Please do not re-arrange furniture. Owner will retain $25 from deposit for moving furniture back.

Inspection

The Landlord have the right to inspect the premises without prior notice at any time to enforce the terms of this agreement. Should the Tenants violate any of the terms of this agreement, the rental period shall be terminated immediately. The Tenants waive all rights to process if they fail to vacate the premises upon termination of the rental period. The Tenants shall vacate the premises at the expiration time and date of this agreement.

Insurance

There is NO personal accident or liability insurance or medical facilities at the house so you are advised to arrange your own. The owners will not therefore accept any responsibility for any loss, damage or accidents or injuries incurred by a guest during their stay whether inside the condo, in the pool, on the property or on the beach.

Internet

High speed wireless internet is provided as a convenience only and is not integral to the agreement. No refund of rents shall be given for outages, content, lack of content, speed, access problems, lack of knowledge of use, or personal preferences with regard to internet service.

Keys

Important!! When you arrive and have paid in full, your keys will be available at the guard gate. We have special security locks and each key costs us $75 to remake. If you lose your key, it will cost you $75 plus the inconvenience of not having access to your condo for several hours…maybe even overnight.

Legal purposes only

Tenant shall use the property for legal purposes only and other use, such as but not limited to, illegal drug use, abuse of any person, harboring fugitives, etc. shall cause termination of this agreement with no refund of rents or deposits.

Occupancy

The Guest agrees to peaceably and quietly use and occupy the Rental Property and agrees not to commit waste nor make any unlawful or offensive use of the Rental Property during occupancy. Occupancy must not exceed the number of persons indicated on the Rental Agreement. Any occupancy over the amount of people indicated in the Rental Agreement will result in immediate eviction and FORFEITURE OF ALL RENT! HOUSE PARTIES ARE PROHIBITED!

Owner's closets

Tenant agrees not to access the owner's closets, even if unlocked, which contains cleaning supplies and chemicals that could be hazardous to children and adults.

Owner & landlord liability

The Tenants and Tenants' Guests shall hereby indemnify and hold harmless the Landlord against any and all claims of personal injury or property damage or loss arising from use of the premises regardless of the nature of the accident, injury or loss. Tenants expressly recognize that any insurance for property damage or loss which the Landlord may maintain on the property does not cover the personal property of Tenants, does not cover any accident, injury or medical insurance and that Tenants should purchase their own medical, loss or any other insurance for Tenants and Guests if such coverage is desired.

Maid/cleaning service

There is NO maid or cleaning service. This can be arranged for $100 per cleaning should you be interested. All renters/tenants are expected to leave the condo in the same or better condition that it was when they first moved in.

Noise

The Tenants shall behave in a civilized manner and shall be good neighbors respecting the rights of the surrounding property owners. The Tenants shall not create noise or disturbances likely to disturb or annoy the surrounding property owners. Creating a disturbance of the above nature shall be grounds for immediate termination of this agreement and Tenants shall then immediately vacate the premises. Quiet hour starts at 8 PM to 8 AM and pool and outdoor noise should cease during this time period.

Non-smoking

This is a non-smoking personal residence. Smoking on the premise is subject to immediate removal with all deposits and payments forfeited.

Number of occupants

Tenants shall have no more than 6 (six) persons (4 adults & 2 children or 2 adults and 4 children) maximum reside or sleep on the premises at any time. This is only if the rental agreement names 6 persons in the contract. Any additional guests must have written permission from the owner.

Occupancy

The Guest agrees to peaceably and quietly use and occupy the Rental Property and agrees not to commit waste nor make any unlawful or offensive use of the Rental Property during occupancy. Occupancy must not exceed the number of persons indicated on the Rental Agreement. Any occupancy over the amount of people indicated in the Rental Agreement will result in immediate eviction and FORFEITURE OF ALL RENT! HOUSE PARTIES, ADDITIONAL GUESTS ARE STRICTLY PROHIBITED!

Owner's Closets

Parking

There is one underground designated parking space for the unit. The guard at the gate will show you the location

Parties

HOUSE PARTIES & OUTSIDE GUESTS ARE STRICTLY PROHIBITED!

Personal & Belongings Security

Tenant shall see to their own security while in the property by locking doors, windows, garage doors, etc. when it's prudent to do so.

Pets (of any kind) are Strinctly Prohibited

Any and all pets found will result in IMMEDIATE EVICTION, a $200 PET FEE AND forfeiture of all rent!

Plants

The owners enhance your stay with expensive tropical plants placed on the terrace and balcony. Guests agree to water the plants at least every other day during their stay.

Refunds

No shows, late arrivals, change in number of persons, and early departures after arrival are non-refundable. There shall be no refunds of rents because of shortened stays, buyer remorse or ruined expectations due to work and family emergencies, medical emergencies, personal injury, health, work, weather or other commitments. No Exceptions! To protect your investment, please purchase trip insurance that will cover such unexpected events.

Repairs

There will be no refunds for any mechanical, appliance or air-conditioning failure. In the event of any problem during your stay notify the Nitta office and the problem will be taken care of as soon as possible. If you experience outages that are beyond our control please report outages as each occurs. No refunds or compensation will be given for any outages.

Return of Deposit

You can expect to receive your security deposit within ten to fifteen days of departure if the length of your stay is under one month, and sixty (60) days of departure if the length of your stay is over a month , unless there is damage to the property. In case of damage, the deposit will be returned, minus cost of repairs or replacements, after repairs or replacements have been made.

Sand

By the outside gate, there is a shower to wash off with and to remove the sand. Be sure that you completely rinse off both your body and your clothes & shoes to insure that all sand has been removed. Sand not only clogs the condo shower and sink drains, it all scratches our highly polished marble floors. If you pick up sea shells, etc, be sure that you also wash off all sand while still OUTSIDE, BEFORE bringing them into the condo.

Satellite TV

Screen Doors

The screened doors are very easy to walk into…especially when it’s dark outside. They are also very expensive to repair and replace. Please be careful not to hurt yourself by running into them. Do NOT force open the screens. They are made to open and shut very easily. If they seem to bind, STOP and try to place the screens back on the tracks properly. Do not use force to open or shut them.

Slippery Floors

The floors are highly polished marble and ARE very slippery when wet. Please be sure to wipe up all water spills promptly. Be safe & healthy!

Smoke/Fire Alarms/Carbon Monoxide Detector

Tennant is advised that there is no carbon monoxide detector or smoke or fire alarms on the property and accepts the risk involved in not having one.

Subleasing

This is a personal private condo residence which CANNOT be subleased. The Tenants shall not sublet the property. Any persons spending the night in the unit which have not been named on the rental agreement will be immediately removed.

Supplies

The condo's are equipped with 1 or 2 color cable television sets, VCR, linens, towels, pillows, pots and pans, dinnerware, glassware and flatware. Beach towels are not furnished.

Swimming Pool

You and your children swim at your own risk. There are NO lifeguards on duty. Please be sure that everybody can swim and is supervised at all times. If you don't swim, please purchase a life jacket and wear it. It is the tenant’s responsibility to learn about safety precautions, warning signs of water conditions, and safety procedures concerning swimming in or being around the pool. Tenant agrees to have a responsible adult supervise all minors while they swim in the pool. Tenant is hereby notified that the pool can be dangerous and tenant accepts fully the risks involved. Tenant is further notified to be cautious when exiting the rear of the home as the pool is open and in close proximity to the entry ways and can be a hazard. There are no rails to prevent a fall into the pool. Please bring and wear a life jacket.

Telephone

The condo does not have a landline. If you have a MagicJack, you can call from the computer on the sixth floor guest business office.

Trip Insurance

Whether you are taking a cruise, flying the skies or renting this condo, you may want to consider purchasing trip insurance. Life is uncertain. You could experience a death in the family, personal health problems, lost luggage, unforeseen weather conditions, need an emergency evacuation or any other unexpected event. Trash Removal

The Tenants shall dispose of all waste material generated during the rental period in a lawful manner and put the trash in the bins in the garage.

Utilities

Rentals of less than one month do not incur costs for utility usage. Rentals of one month or more will be charged for actual electricity used. In Mexico, the electricity is very, very expensive. Please shut off all lights not in use, and use the air conditioning only when necessary. When using the air conditioning, please be sure that all windows and doors are completely shut.

Valuables & Personal Items

Owners accept no responsibility for the lost, misplacement, or left behind personal items. Please check the entire premise for all personal items before you leave for home.

Visiting Guests/Parties

This personal, private condo residence is rented with the intention that the only persons occupying the unit at any time is the contracted overnight guests.

Zero Tolerance

Guest and the members of his party shall not use or permit to be brought into the condo or onto the property any illegal controlled substances, firearms, or items hazardous to persons or property. In addition, smoking on premises is not allowed. This is a non-smoking guest house.

Conclusion

All guests and renters agree to abide by the rules and regulations of the Nitta Condo Association in Nuevo Vallarta and to abide by the rules and regulations of this condo rental agreement. No exceptions are made to this agreement, whether verbal, implied or written.
